自王弼提出「體用」一詞，體用概念即成為中國哲學史的重要範疇，而表現為一理解世界、詮釋世界的思維格式。以此思維格式為基礎，哲人建構出各具旨趣的思想體系及宇宙圖式；是故，透過對哲人體用觀的探析，應可相當程度地掌握其思維線索，並釐辨構築於此思維線索上的思想內容。 雖然如此，學者在論析哲人之體用思想時，或常以未經清楚說明及嚴格界義的「即體即用」、「體用不二」、「體用一如」、「體在用中」等成詞同時詮釋不同哲人的體用思想，而未能明確的論述何謂「一如」、如何「不二」，「即體即用」、「體在用中」又當於何理論前提及範疇中立說。亦即因此，或未能彰顯哲人彼此間的思維異同，說解的本身亦或有含胡之失。 基於以上認知，本文力求以明確的語言形式及概念分析來詮釋船山的體用思想，並檢視由此思維核心所開展出的思想體系，而將檢視對象鎖焦於天道、性命、人文化成三範域。 船山的體用思想蘊具飽滿、層次嚴密，而可以「體用相涵」一語收攝其義。經過重重爬梳及論闡，可精確說明其意謂：「體用相涵」即「用在體中」、「體在用中」，而表現為結構意義、時間意義、空間意義、實現意義及存在內容等範疇的相涵，其中充滿著時間感、空...

本文之目的，在探討國際法的海洋污染問題，為求深入，將把重點置於由「船舶」 引起的「油料」污染。 第一章為海洋污染之定義，種類及原因，並將仔細研究海洋污染之原因及防止方法 。第二至四章則在討論現行防止海洋油料污染之國際法規則，分別為：習慣國際法 與海洋污染，國際防止油污公約，現行制度之優劣得失。第五章則針對現行制度缺 失，討論過去數年來各國家及學者所提出之改善意見，第六章則以聯合國第三次海 洋公會議中之「非正式綜合談判草約」(ICNT)是否能截各種意見之長補現行制度之 短做論文結論。 由於海洋污染亦為一高度科技性問題，文中將以法律問題為重，技術方面亦不可避 免涉及，但非本文重點，亦非作者能力所及。
