"近世以來，交通發達，貿易流暢，普世之國，全球之民，交通頻繁，接觸日增，相互關係愈形密切，空間距離日形縮短，涉外關係隨之遽增，尤其海洋為國與國間天然之聯絡地帶，在所有私法範疇中，海商法最具國際性及涉外性。 本論本係對海事國際私法中船舶優先權之研究，共分十章，計六百四十餘項，約五十萬字，其要點如下：第一章「緒論」，敍述撰寫本課題之動機、目的、研究方法與內容結。第二章「海事國際私法中船舶優先權之基礎論」，先述海事國際私法中物的基礎「船舶」之法律性格之衝突及其準據法選擇，並論述船舶優先權之基本概念與其在海事國際私法中之地位。第三章探討「船舶優先權之法律衝突」，立於國際私法觀點，將船舶優先權之債權項目、標的、順位及消滅，擇英、美、德、日與我國法律及兩公約為比較，以發現法律衝突之所在。第四章專論「船舶優先權之定性問題」，先述定性標準與學說，次述學理上船舶優先權可能定性之理論，並述各國實務上如何定性，最後說明性之評析與超越。第五章闡述「船舶優先權準據法決定之基礎理論」，歸納七種準據法選擇之理，分析其論據，舉出例證並為評價，最後並對最新選法理論為介紹。第六章論及「船舶優先權準據法決定之決制實現」，列...
