我國於民國八十八年修訂完成之海商法海上保險章雖有佐參英國一九０六年海上保險法及英國海上保險所適用保單條款及實務作一修訂參考，惟覺有待修改缺失之處尚多，爰著手修改意見撰述。 　　本文謹先就研究動機、目的、方法、範圍及內容作一申述，再就海上保險概念、性質、沿革、制度、範圍及內容作一說明，並就民國五十一年及八十八年二次修改內容、方向、精神、及範圍作一概略性說明。進一步再就海上保險章分類逐條提出說明及評論，進而提出逐條修正意見，亦即就我國海商法海上保險章共廿七條條文作逐一之修正建議意見。 　　本文主要參酌英國一九０六年海上保險法及英國保單條款、實務經驗，予以完整融入修正意見內，期使實務與法條理論能更切合實際，是本論文提出最大用意。本文在最後之結論及建議即就海商法海上保險章之現行條文、建議修正條文及說明以表列方式提出，藉以用較清楚表達方式陳列出來，以表達本論文撰述的目的。

共同海損與單獨海損為海上保險中之主要賠償項目。因為共同海損之性質、要件，甚為特殊、複雜、與單獨海損(火冏)不相同，故而海上保險人對於共同海損之理賠，亦與單獨海損有別。本論文係以共同海損發生之原因為出發點，分別就自然之因素及人為之因素探討共同海損與海上保險之關係。全文分為五章、十四節，共十萬餘字；各章之內容約略如下： 第一章：導論：本章係就共同海損之意義，及其於海上保險之地位加以介紹，並說明本論文研究之動機及方法。 第二章：共同海損與海上保險之關係：本章分為四節，就海上保險契約所承保之危險，造成之共同海損，敘述保險人對於共同海損之犧牲及共同海損費用之賠償責任方法、範圍。並討論船舶、貨物、運費同屬一人所有，及空船航程中，海上保險對於共同海損成立與否之影響。 第三章：適航能力：本章分為七節，以探討因船舶欠缺適航能力造成共同海損時保險人之責任為主旨，介紹適航能力之意義及航程保單、定時保單中，保險人對於因船舶欠缺適航能力致生損失之基本責任，潛在瑕疵與適航能力之關係。最後以海上保險對於適航能力所造成共同海損之賠償關係總結。 第四章：防護及補償保險：本章分為三節，介紹防護及補償保險、P & I Cl...
